Senior associates Anneli Aab <\/a>and Aivar Pilv <\/a>of the LEADELL Pilv Law Office are representing in court dispute the Estonian composer Ivar Must who is claiming author\u2019s remuneration from the company P\u00f5ltsamaa Felix with regard to using the feature tune \u201eP\u00f5ltsamaa, ehtne ja hea\u201c in their ad campaigns for years without the consent of the author.<\/p>\n

The dispute is resulting from the feature tune \u201eP\u00f5ltsamaa, ehtne ja hea\u201c which was composed for a juice advertisement already in 1994. P\u00f5ltsamaa Felix has used the composition of Ivar Must without his consent for more than 20 years without paying any remuneration to the author.<\/p>\n

An author has the sole right to use his or her work and determine the form and extent of use by others. The Copyright Act is also clearly establishing that an author has the right to obtain remuneration for the use of the author\u2019s work by other persons. Furthermore, besides using the creation of Ivar Must during such a long period for business purposes without asking for the consent of the composer, neither has the author received any remuneration for the use of the feature tune \u201eP\u00f5ltsamaa, ehtne ja hea\u201c in numerous ad campaigns over the decades.<\/p>\n","protected":false},"excerpt":{"rendered":"
